These Terms and Conditions apply to reservations and vehicle rentals provided by First Hawaii Rental LLC, DBA First Rent A Car ("First Rent A Car," "we," "us," or "our").

By making a reservation, renting a vehicle, or signing a Rental Agreement, the renter agrees to these Terms and Conditions and the applicable Rental Agreement.

The signed Rental Agreement governs the specific rental. If there is any conflict between these Terms and Conditions and the signed Rental Agreement, the Rental Agreement will control.

01 Reservations and Vehicle Availability

Reservations are subject to vehicle availability and satisfaction of all rental requirements.

A reservation does not guarantee a particular make, model, color, trim, or feature unless specifically confirmed in writing. First Rent A Car may provide a comparable or upgraded vehicle when the reserved vehicle is unavailable.

Rates, taxes, optional products, additional services, and other applicable charges will be disclosed during booking, at the rental counter, or in the Rental Agreement.

Changes to the reservation, rental period, vehicle category, or optional services may affect the final price.

First Rent A Car may correct website, pricing, or reservation errors and may refuse or cancel a rental when rental requirements are not satisfied, information provided is inaccurate, or the transaction presents a safety, fraud, payment, or operational concern.

02 Renter Qualifications and Authorized Drivers

The renter and every authorized driver must satisfy First Rent A Car's rental requirements and present a valid driver's license and any other identification or documentation reasonably requested.

Only drivers listed and authorized in the Rental Agreement may operate the vehicle.

The renter is responsible for the vehicle and for the conduct of every authorized or unauthorized person who operates or possesses it during the rental period.

Providing false, incomplete, expired, or misleading information may result in refusal or termination of the rental and may affect any optional protection selected by the renter.

03 Payment Authorization

A valid and acceptable payment method may be required at the time of rental.

By providing a payment method, the renter authorizes First Rent A Car to charge all amounts properly due under the Rental Agreement, including rental charges, taxes, optional products, extensions, fuel, cleaning beyond ordinary use, damage, applicable deductibles, towing, recovery, tickets, tolls, administrative charges, and other authorized amounts.

Certain charges may be processed during or after the rental when they become known. The renter remains responsible for all amounts due even if the payment method provided is declined, expired, canceled, disputed, or otherwise unavailable.

04 Insurance, Loss Damage Waiver and Financial Responsibility

Insurance Required by Law

First Rent A Car vehicles are covered by automobile liability insurance as required by Hawaii law.

Any applicable coverage is subject to the terms, conditions, limits, exclusions, and priority-of-coverage rules of the applicable insurance policy and Hawaii law.

Such coverage does not eliminate the renter's obligations or financial responsibility under the Rental Agreement.

Optional Loss Damage Waiver

Loss Damage Waiver ("LDW") is optional, is available for an additional charge, and is not insurance.

Purchasing LDW is not required to rent a vehicle.

When purchased and valid, LDW may waive or reduce the renter's financial responsibility for loss of or damage to the First Rent A Car vehicle, subject to the selected LDW option, any applicable deductible, and all terms, conditions, limitations, and exclusions stated in the Rental Agreement.

LDW applies only to the First Rent A Car vehicle. It does not provide liability insurance or coverage for injuries to any person, damage to another vehicle or property, personal belongings, or any other third-party claim.

Any deductible applicable to the selected LDW option remains the renter's financial responsibility and is payable when due under the Rental Agreement and applicable law.

If the renter declines LDW, or if LDW becomes invalid because of a violation of the Rental Agreement, the renter remains financially responsible for loss of or damage to the rental vehicle and any related charges authorized under the Rental Agreement and applicable law.

Available LDW options, prices, and applicable deductibles will be provided at the rental counter and stated in the Rental Agreement.

LDW charges are nonrefundable once the rental period begins, regardless of whether any loss or damage occurs.

Personal Automobile Insurance

A renter's personal automobile insurance may provide coverage for rental vehicles.

Renters should confirm the availability, terms, limits, exclusions, and applicable deductibles of any personal coverage before declining LDW.

A renter who declines LDW and intends to rely on personal automobile insurance may be required to provide acceptable proof of current coverage, including collision and comprehensive coverage applicable to rental vehicles.

Reviewing or accepting proof of insurance does not guarantee that a claim will be covered and does not release the renter from responsibility under the Rental Agreement.

The renter remains directly responsible to First Rent A Car for all amounts properly due and must independently seek reimbursement from the renter's insurance company.

Credit Card Rental Protection

Credit-card rental protection and similar cardholder benefits are not accepted as proof of personal automobile insurance and do not reduce the renter's responsibility to First Rent A Car.

First Rent A Car does not submit or administer claims directly with credit-card issuers or benefit providers.

The renter remains responsible for all amounts properly due under the Rental Agreement and may independently seek reimbursement from the applicable credit-card issuer or benefit provider.

05 Vehicle Use and Restrictions

The vehicle must be operated carefully, lawfully, and only for its intended purpose.

The vehicle may not be:

  • Operated by an unauthorized driver;
  • Used while the driver is impaired, intoxicated, fatigued, or otherwise unfit to drive;
  • Used for any illegal activity;
  • Used for racing, speed testing, reckless driving, driver training, or competition;
  • Driven off-road or on roads unsuitable for ordinary passenger vehicles;
  • Used to tow, push, or transport another vehicle or object;
  • Subleased or used for rideshare, delivery, or other commercial purposes without written authorization;
  • Overloaded or used to transport more passengers than legally permitted;
  • Transported off the island of O'ahu; or
  • Used in any manner that violates the Rental Agreement or applicable law.

The renter must properly secure the vehicle, safeguard the keys, close the windows, and take reasonable precautions against loss, theft, vandalism, and damage.

Smoking and vaping inside the vehicle are prohibited. Cleaning or restoration required beyond ordinary use may result in additional charges.

A violation of these requirements may terminate the rental, affect LDW or other protections, and make the renter responsible for resulting loss, damage, and expenses.

06 Vehicle Condition and Care

The renter must inspect the vehicle at pickup and promptly report any unrecorded existing damage or condition concern.

The vehicle must be returned in substantially the same condition in which it was received, except for ordinary wear resulting from proper use.

The renter must stop using the vehicle and contact First Rent A Car immediately if a warning light, unusual sound, mechanical concern, unsafe condition, or other problem occurs.

The renter may not authorize repairs, replacement parts, or towing without approval from First Rent A Car, except when necessary to address an immediate emergency.

Unauthorized repairs or services may not be reimbursed.

07 Lockouts, Fuel, Tires, Windows and Towing

Standard assistance does not include costs associated with lockouts, lost or damaged keys, incorrect fuel, depleted fuel, tire or wheel damage, windshield or window damage, or towing resulting from these conditions or from renter use, misuse, negligence, or violation of the Rental Agreement.

The renter is responsible for these costs unless the Rental Agreement expressly provides otherwise.

The renter must contact First Rent A Car before arranging towing, roadside service, repairs, replacement keys, or other assistance whenever reasonably possible.

08 Fuel, Cleaning, Parking, Tickets and Tolls

The vehicle must be returned with the fuel level required by the Rental Agreement.

Fuel shortages, incorrect fueling, and resulting damage or service costs may be charged to the renter.

The renter is responsible for parking charges, traffic violations, citations, tolls, towing, impound charges, and related administrative expenses arising during the rental period.

These amounts may be charged after the vehicle is returned if First Rent A Car receives notice of them later.

The renter may also be responsible for cleaning required beyond ordinary use, including cleaning resulting from smoking, excessive sand, stains, spills, odors, or other unusual conditions.

09 Accidents, Damage, Theft and Breakdowns

The renter must contact First Rent A Car immediately following any accident, damage, theft, vandalism, breakdown, or other incident involving the vehicle.

For every accident, the renter must contact the police and obtain an official police report or incident number.

If another vehicle or person is involved, the renter must obtain the other driver's name, contact information, driver's license information, license-plate number, vehicle registration, and insurance information.

The renter should also collect available witness information and photographs of the vehicles, damage, and accident scene.

The renter must not admit fault, promise payment, abandon the vehicle, or settle any claim without authorization from First Rent A Car.

The renter must cooperate fully with First Rent A Car, law enforcement, insurers, and claims representatives and must provide all requested information and documentation.

For damage or breakdowns, the renter must contact First Rent A Car before arranging repairs, towing, or other services whenever reasonably possible.

Failure to follow these requirements may result in the renter being responsible for resulting vehicle damage, repairs, towing, recovery, and related expenses.

10 Failure to Return the Vehicle and Recovery Costs

The vehicle must be returned on the date and at the time stated in the Rental Agreement unless an extension is approved by First Rent A Car.

Keeping the vehicle beyond the authorized rental period without approval may be treated as unauthorized possession.

First Rent A Car may take lawful steps to locate and recover the vehicle and, when appropriate, report the vehicle to law enforcement.

The renter is responsible for additional rental charges and for costs resulting from the failure to return the vehicle, including reasonable towing, recovery, transportation, administrative, legal, and related expenses.

11 Return Location

The vehicle must be returned to the location stated in the Rental Agreement.

Unauthorized returns to another location may result in additional charges.

12 Personal Belongings

First Rent A Car is not responsible for personal belongings that are lost, stolen, damaged, or left inside the vehicle.

The renter is responsible for removing all personal belongings before returning the vehicle.

First Rent A Car does not guarantee the recovery, storage, or return of any item left behind.

13 Child Safety Seats and Booster Seats

Child safety seats, booster seats, and similar accessories may be available as optional rental items for the renter's convenience.

The renter is solely responsible for selecting the appropriate seat, inspecting its condition, confirming that it is functioning properly and suitable for the child and vehicle, and installing and using it correctly.

First Rent A Car does not install child safety seats or booster seats.

The renter must follow all manufacturer instructions and applicable safety laws and must discontinue use and notify First Rent A Car immediately if any concern is identified.

First Rent A Car is not responsible for improper selection, installation, adjustment, or use of a child safety seat or booster seat.

14 Other Optional Equipment

Optional equipment and accessories are subject to availability and may carry additional charges.

The renter is responsible for inspecting optional equipment at pickup, using it properly, protecting it from loss or damage, and returning it with the vehicle in the condition in which it was received.

Lost, damaged, or unreturned equipment may result in additional charges.

15 Payment of Deductibles, Damage and Unpaid Amounts

All amounts properly due under the Rental Agreement, including any applicable LDW deductible, vehicle loss or damage, towing, recovery, administrative charges, and other authorized amounts, must be paid when due under the Rental Agreement and applicable law.

The renter authorizes First Rent A Car to charge the payment method provided for amounts properly due.

Unpaid amounts may be referred for collection or pursued through lawful court proceedings.

The renter may also be responsible for reasonable collection expenses, court costs, and attorneys' fees as permitted by applicable law.

16 Limitation of Responsibility

First Rent A Car is not responsible for delays, missed flights, missed reservations, loss of enjoyment, interruption of travel plans, or other indirect or consequential loss resulting from vehicle unavailability, mechanical problems, accidents, weather, road closures, government action, or circumstances beyond our reasonable control.

When reasonably possible, First Rent A Car may provide assistance or a replacement vehicle, subject to availability and the circumstances of the incident.

Nothing in these Terms and Conditions limits any responsibility that cannot legally be limited under applicable law.

17 Privacy

Personal information collected during reservations and rentals is handled in accordance with the First Rent A Car Privacy Policy .

By providing contact information, the renter agrees that First Rent A Car may communicate regarding the reservation, rental, vehicle, payment, safety matters, claims, or customer-service issues.

18 Changes to These Terms

First Rent A Car may update these Terms and Conditions periodically.

Updates become effective when posted on the website unless otherwise stated.

The Terms and Conditions applicable to a specific rental are those in effect at the time of the reservation or those included in the signed Rental Agreement.

19 Governing Law and Severability

These Terms and Conditions and all rentals are governed by the laws of the State of Hawaii.

Any dispute relating to a reservation or rental will be handled in the appropriate court or forum located in Hawaii unless the Rental Agreement or applicable law requires otherwise.

If any provision is determined to be invalid or unenforceable, the remaining provisions will remain in effect.

20 Complete Agreement

These Terms and Conditions, the reservation confirmation, the Rental Agreement, and any documents incorporated into the Rental Agreement constitute the agreement between the renter and First Rent A Car concerning the rental.
